What NautiBay is
A place to post and browse listings — boats for sale, berths, charter, fishing trips, crew, and marine businesses. We are not a party to any deal you make with another user.
Your listings
Must be accurate, legal, and about boating. No scams, no fake offers, nothing illegal or off-topic.
Deals happen off the platform
You arrange payment, inspection, and hand-over directly with the other person. NautiBay does not handle money and cannot recover it.
We can remove content
We may take down any listing or account that breaks these rules, without notice.
Age
You must be at least 18 (or the age of majority in your country) to use NautiBay.

1. Who we are and what this service does

NautiBay.com ("NautiBay", "we", "us") operates an online platform where users publish and search classified listings related to boating: boats for sale, berths and storage, charter and cruises, sea-fishing trips, crew profiles, and marine service businesses.

NautiBay only provides the platform. Every transaction, agreement, trip, or service is strictly between the users involved. We are not the seller, buyer, landlord, tenant, charter operator, skipper, employer, or service provider, and we are not an agent or broker for any of them.

2. Eligibility

You must be at least 18 years old, or the age of majority in your country of residence if that is higher, and legally able to enter into contracts.

By creating an account or using NautiBay you confirm that this is true and that the information you give us is accurate.

3. Your account

You are responsible for everything done through your account and for keeping your password secure. Tell us immediately if you think someone else has access to it.

One person or business may not run multiple accounts to evade limits or moderation.

4. Rules for listings and content

  • Listings must be genuine, accurate, and relate to boating.
  • You must have the right to sell, rent, or offer whatever you list.
  • No fraudulent, misleading, or fake listings, and no bait-and-switch.
  • No illegal goods or services, no weapons, no stolen property, no counterfeit items.
  • No adult content, gambling, cryptocurrency schemes, or anything unrelated to boating.
  • No spam, no duplicate listings for the same item, no misuse of the "bump to top" feature.
  • Contact details you publish are shown to other signed-in users so they can reach you about your listing.

You keep ownership of the text and photos you upload, but you grant NautiBay a non-exclusive, worldwide licence to host, display, resize, and — if you opt in — promote your listing on NautiBay and on connected platforms, for as long as the listing is published.

5. Transactions between users

NautiBay is not involved in any payment, deposit, contract, inspection, delivery, or dispute between users.

Never send money or a deposit before you have seen the boat, berth, or service in person and satisfied yourself that the other party and the offer are genuine. NautiBay cannot recover funds and is not responsible for losses from dealings with other users.

You are responsible for complying with all laws that apply to you — including any licence, registration, tax, safety, insurance, and age requirements for owning or operating a vessel in your country.

6. Moderation and removal

We may review, edit, refuse, hide, or delete any listing or account, and suspend or close accounts, at our discretion — in particular where we believe these Terms have been broken or where content is unlawful, unsafe, or harmful. Where practical we will tell you why.

7. Availability and changes

The service is provided "as is". We do not guarantee it will always be available, error-free, or that listings are accurate or up to date.

We may change these Terms or the features of the service. If we make a significant change we will post a notice on the site. Continuing to use NautiBay after a change means you accept the updated Terms.

8. Liability

To the fullest extent allowed by law, NautiBay is not liable for any loss or damage arising from: dealings or communications with other users; the content or accuracy of any listing; the condition, legality, or safety of any boat, berth, trip, or service; or any interruption of the service.

Nothing in these Terms limits liability that cannot be limited under the law that applies to you.

9. Governing law and disputes

These Terms are governed by the law of the place where the operator of NautiBay is established, and any dispute will be dealt with by the competent courts of that place, unless mandatory consumer-protection law in your country of residence gives you the right to bring proceedings elsewhere.
